For this reason, the following cancellation policy applies to all bookings.<\/p><h4>1. Acceptance of Terms<\/h4><p>By confirming a booking and\/or making any payment, the customer expressly accepts these Terms and Conditions, including the following Cancellation Policy.<\/p><p>These terms form part of the legally binding agreement between the customer and Scuba Legends.<\/p><h4>2. Identification of the Contracting Party<\/h4><p>The person completing the booking (hereinafter\u00a0<strong>\u201cthe Contracting Party\u201d<\/strong>) acts on behalf of all participants included in the booking and is solely responsible for:<\/p><ul><li>Communication with Scuba Legends<\/li><li>Submitting any modifications or cancellation requests<\/li><li>Accepting the Terms and Conditions on behalf of all participants<\/li><\/ul><p>Requests from other participants will not be considered valid.<\/p><h4>3. How to cancel<\/h4><p>All cancellations must be submitted\u00a0<strong>in writing by email<\/strong>\u00a0to:<\/p><p><strong>info@scuba-legends.com<\/strong><\/p><p>A cancellation is only considered valid once it has been\u00a0<strong>received and confirmed by Scuba Legends<\/strong>.<\/p><ul><li>Messages via WhatsApp, phone, or social media are not valid cancellation methods<\/li><li>Scuba Legends is not responsible for emails not received due to technical issues, spam filters, or incorrect address entry<\/li><\/ul><p>We recommend requesting an automatic delivery or read receipt via your email provider.<\/p><h4>4. How cancellation deadlines are calculated<\/h4><p>Cancellation deadlines are based on\u00a0<strong>calendar days, not hours<\/strong>.<\/p><ul><li>The day of the activity itself is not counted<\/li><li>The required number of full days must be completed before the activity date<\/li><\/ul><p><em><strong>Example: 2 full days cancellation deadline<\/strong><\/em><br \/><em>Activity date: 7 January (any time)<\/em><br \/><em>Cancellation deadline: 4 January at 23:59<\/em><\/p><p>This rule applies to all bookings unless otherwise specified below.<\/p><h4>5. Cancellation Deadlines<\/h4><h5>5.1 Recreational diving, snorkeling and non-professional courses<\/h5><p>This applies to snorkeling, guided dives, try dives, and recreational diving courses.<\/p><ul><li><strong>Up to 2 full days before the activity date (23:59):<\/strong>\u00a0Full refund<\/li><li><strong>From 2 full days before the activity date (00:00 of the second day prior):<\/strong>\u00a0No refund and no rescheduling; 100% charges apply.<\/li><\/ul><p><strong data-start=\"185\" data-end=\"233\">Group bookings (4-9 participants)<\/strong><\/p><ul><li><strong>Up to 15 full days before the activity date (23:59):<\/strong>\u00a0Full refund<\/li><li><strong>Between 15 and 3 full days before the activity date (23:59):<\/strong>\u00a050% refund; no rescheduling; 50% charges apply.<\/li><li><strong>From 2 full days before the activity date (00:00 of the second day prior):<\/strong>\u00a0No refund and no rescheduling; 100% charges apply.<\/li><\/ul><p data-start=\"185\" data-end=\"233\"><strong>Group bookings (10+ participants)<\/strong><\/p><ul><li><strong>Up to 30 full days before the activity date (23:59):<\/strong>\u00a0Full refund<\/li><li><strong>Between 30 and 15 full days before the activity date (23:59):\u00a0<\/strong>50% refund; no rescheduling; 50% charges apply.<\/li><li><strong>From 14 full days before the activity date (00:00 of the 14th day prior):\u00a0<\/strong>No refund and no rescheduling; 100% charges apply.<\/li><\/ul><h5>5.2 Professional Courses (from Divemaster level)<\/h5><p data-start=\"1238\" data-end=\"1388\">All professional-level training requires a deposit to secure the booking, as well as full payment for PADI course materials, which are non-refundable.<\/p><ul data-start=\"1390\" data-end=\"1757\"><li data-section-id=\"fmbp8k\" data-start=\"1390\" data-end=\"1505\">More than\u00a0<strong data-start=\"1402\" data-end=\"1452\">30 full days before the activity date (23:59):<\/strong>\u00a0Full refund (excluding deposit and PADI materials)<\/li><li data-section-id=\"15tqf9s\" data-start=\"1506\" data-end=\"1625\">Between\u00a0<strong data-start=\"1516\" data-end=\"1573\">30 and 11 full days before the activity date (23:59):\u00a0<\/strong>50% refund; no rescheduling; 50% charges apply\u00a0(excluding deposit and PADI materials)<\/li><li data-section-id=\"jb4ljw\" data-start=\"1626\" data-end=\"1757\">From\u00a0<strong data-start=\"1633\" data-end=\"1705\">10 full days before the activity date (00:00 of the 10th day prior):<\/strong>\u00a0No refund and no rescheduling; 100% charges apply<\/li><\/ul><h5>5.3 Technical diving courses and technical diving excursions<\/h5><p data-start=\"1826\" data-end=\"1900\">A specific cancellation policy applies to all technical diving activities:<\/p><ul data-start=\"1902\" data-end=\"2191\"><li data-section-id=\"xapboe\" data-start=\"1902\" data-end=\"1978\">More than\u00a0<strong data-start=\"1914\" data-end=\"1964\">15 full days before the activity date (23:59):<\/strong>\u00a0Full refund<\/li><li data-section-id=\"jxi1w9\" data-start=\"1979\" data-end=\"2058\">Between\u00a0<strong data-start=\"1989\" data-end=\"2045\">15 and 3 full days before the activity date (23:59):<\/strong>\u00a050% refund; no rescheduling; 50% charges apply.<\/li><li data-section-id=\"12mu4iq\" data-start=\"2059\" data-end=\"2191\">From\u00a0<strong data-start=\"2066\" data-end=\"2139\">2 full days before the activity date (00:00 of the second day prior):<\/strong>\u00a0No refund and no rescheduling; 100% charges apply<\/li><\/ul><h4>6. Multi-day bookings<\/h4><p>If a booking includes several days or activities:<\/p><p><strong>The booking is considered fully commenced once the first activity starts.<\/strong><\/p><p>After this point:<\/p><ul><li>No partial cancellations<\/li><li>No refunds for remaining services<\/li><\/ul><h4>7. Changes, reductions &amp; discounts<\/h4><p>If a booking is modified (e.g. add-ons, change of participants, services or activities):<\/p><ul><li>Any group discount, package price, or promotion becomes void<\/li><li>The booking will be recalculated using standard individual shop prices<\/li><\/ul><h4>8. Non-refundable costs already incurred<\/h4><p>Some costs are committed in advance and cannot be recovered, even if a booking is cancelled within the cancellation period.<\/p><p>These may include:<\/p><ul><li>Course materials (e.g. manuals, eLearning access)<\/li><li>Individual equipment purchases<\/li><li>Dive accident insurance<\/li><li>Specific third-party services<\/li><\/ul><p>These costs will be retained to the extent already incurred and non-recoverable in the event of cancellation or changes, even if a partial refund would otherwise apply.<\/p><h4>9. Vouchers &amp; credits<\/h4><ul><li>Vouchers and credits are non-refundable once purchased<\/li><li>They must be used within their validity period (365 days from the moment of purchase)<\/li><li>Once activity dates are confirmed, no refund or rescheduling is possible<\/li><\/ul><h4>10. Late arrival \/ no-show<\/h4><ul><li>More than 15 minutes late is considered a no-show<\/li><li>When transfers are involved (land or water), any delay will prevent participation in the activity.<\/li><li>No refund or rescheduling applies<\/li><\/ul><h4>11. Participation requirements<\/h4><p>No refund applies if participation is not possible due to:<\/p><ul><li>Missing medical clearance (review\u00a0<a href=\"https:\/\/www.uhms.org\/resources\/recreational-diving-medical-screening-system.html?fbclid=IwAR0n5fU7421gC0gE4TXCenSMftrorwaRXeS5FYEsIpHT_o7FyQr071SoU-Q\" target=\"_blank\" rel=\"noopener\">medical questionnaire<\/a>\u00a0prior to booking!)<\/li><li>Incomplete or late online check-in<\/li><li>Failure to complete required theory prior to course start<\/li><li>Arriving under the influence of alcohol or drugs<\/li><li>Not meeting requirements communicated in advance<\/li><\/ul><h4>12. Weather conditions<\/h4><p>Activity locations are selected based on safety, weather conditions, and experience level. Wind, rain, waves, or clouds do not entitle to free cancellation. If weather or unforeseen circumstances affect a booking, activities may be relocated or adapted. If an activity cannot take place, a reschedule or a voucher for the remaining services will be offered.<\/p><h4>13. Goodwill exceptions<\/h4><p>Any exception outside this policy is granted voluntarily and without legal obligation. Ensuring medical fitness for diving is the responsibility of each participant, and a medical certificate may be required for certain medical conditions. Therefore, before booking or participating in any diving activity, it is essential to carefully review the medical questionnaire.<\/p><p>If a medical certificate is required, participants must follow the instructions outlined in the form. Subsequently, please email a scanned PDF copy of the completed document, ideally no later than 2 days before the scheduled activity.<\/p><p>If a participant is unable to provide a medical certificate signed by a qualified physician when required, Spanish law prohibits participation in diving activities. Unfortunately, under such circumstances, neither refunds nor rescheduling will be possible.<\/p><p>Please note that diving is an adventure sport that carries inherent risks. Your honesty is required and is particularly important for your own safety, the safety of your dive buddy, and the well-being of our staff. It is important to understand that certification cannot be guaranteed solely through payment.<\/p><p>Our training sessions strictly adhere to the standards established by the relevant diving association. Most skills build upon one another and require successful completion before progressing further. Unless a private course has been arranged, if a student chooses to interrupt their training or is unable to meet the required skill standards despite having sufficient time to practice and develop those skills, the instructor must continue with the remaining participants to ensure the course progresses as scheduled.<\/p><p>As outlined in our Cancellation Policy, no refunds or rescheduling will be provided in such cases. However, additional training sessions may be arranged at an extra cost, subject to availability.<\/p><p>The Open Water Course is designed specifically for beginners and requires no prior diving experience. However, if you do not yet feel comfortable in the ocean or are uncertain about pursuing certification, we recommend trying a Discover Scuba Diving experience before enrolling in a course.<\/p><p>If you are particularly nervous or have had a previous negative experience, you may wish to consider booking a private course. This allows the instructor to focus entirely on your individual needs and progress.
